Data protection is of particular concern to us. Our activities to meet the requirements of the General Data Protection Regulation (GDPR), the German Federal Data Protection Act (BDSG), the German Telemedia Act (TMG) and the German Social Code X (SGB X) are aimed at expressing our respect for your private and personal sphere.

2. What personal data is and where we receive it from

"Personal data" means any information relating to an identified or identifiable natural person (hereinafter referred to as "data subject"); an identifiable natural person is one who can be identified, directly or indirectly, in particular by assignment to an identifier such as a name, an identification number, location data, an online identifier or to one or more special characteristics which express the physical, physiological, genetic, psychological, economic, cultural or social identity of that natural person.

a) Data arising during your visit to the website

As a matter of principle, you can view our Internet pages without providing any personal data. By default, we only store the website from which you accessed our site, the name of your Internet service provider, which websites you have visited within our Internet offering and the date and duration of your visit. For this purpose, small files (so-called cookies) are stored in the main memory of your computer for the duration of your visit. These are so-called temporary session cookies (for permanent cookies, see section 9 below). Session cookies are automatically deleted as soon as you close your browser window. We use session cookies to create a so-called session ID for internal statistical purposes. The data collected is completely anonymous, so there is no way to identify you as a person.

Your IP address and a time stamp are stored for security reasons and are only used for internal purposes. The IP address is a machine-related identifier that makes a statement about the computer used for Internet access or Internet gateway at the time of the online query. The term time stamp refers to a value in a defined format that assigns an event (for example, sending or receiving a message, modifying data, etc.) a time. The purpose of a time stamp is to make it clear to people or computers when which events occurred.

b) Personal data that you provide to us via a form

We receive your personal data when you enter this data in the forms on our site (e.g. to participate in a competition) and thus make it available to us. This is the following data:

  • Your gender,
  • Your full and real name,
  • Your email address,
  • Your phone number,

3. The purposes for which we use your personal data​

Personal data may only be processed by us with your or a legal permission from the GDPR, the BDSG or any other laws regulating data protection.

a) Processing for the fulfilment of contractual obligations (Article 6 Section 1 b) GDPR)​

Sweepstake data is primarily used to conduct the sweepstake, i.e. to determine the prize and to contact a winner. If no advertising consent is given, no further use will take place.

b) processing for the protection of legitimate interests (Article 6 Section 1 f) GDPR)​

If you have given your advertising consent, we also use the data for advertising purposes, i.e. for contacting you by telephone or email.

c) Processing on the basis of your consent (Article 6 Section 1 a) GDPR

We also use your data for advertising purposes on the basis of your advertising consent (cf. Section 3 b), so that the use of the data for direct advertising is permitted for two legal reasons.

4. Who receives your data and when it is transferred to third countries

Internally, all departments have access to your data, which the data need in order to fulfill the above-mentioned purposes. We also use external service providers to process the data for these purposes. These external service providers are primarily companies that support us in direct advertising. It will be contractually guaranteed that these external service providers will only use the data for advertising purposes within the framework of the consent given, i.e. for advertising our products.

5. How long your data will be stored​

How long your data is stored depends on the legal basis of data processing:

Data that we have received without simultaneous advertising consent will be deleted at the latest one month after the end of the sweepstake by sending the prize.

We store data which we use for advertising purposes for three years from the last use for advertising purposes or a revocation. It will be used for the last time no later than one year after registration.

Due to our legal obligations, we may be required to maintain certain data for a longer period of six to ten years. During this period, the data is not used for purposes other than archiving.

After the expiry of the last of the above-mentioned storage periods, the data will remain stored for up to three further months so that we can implement a technically thorough and scheduled deletion. Within these three months, the data will no longer be processed for other purposes.

6. Your rights of data subjects and your revocation of consent​

The General Data Protection Regulation guarantees you certain rights that you can assert against us. You have the right:

  • to request confirmation from us whether personal data relating to you are processed and, if so, the detailed circumstances of the data processing (Article 15 GDPR: right of the data subject to obtain information),
  • to immediately request us to correct any incorrect personal data concerning you. Taking into account the purposes of the processing, you also have the right to request the completion of incomplete personal data - also by means of a supplementary declaration (Article 16 GDPR: right to correction),
  • to require us to delete personal data relating to you without delay (Article 17 GDPR: right of deletion),
  • to require us to restrict processing (Article 18 GDPR: right to restrict processing),
  • in the event of processing on the basis of your consent or in order to fulfil a contract, to receive the personal data concerning you that you have provided to us in a structured, current and machine-readable format and to transmit this data to another person responsible without our interference or to transmit the data directly to the other responsible person, insofar as this is technically feasible (Article 20 GDPR: right to data transferability),
  • to object at any time for reasons arising from their particular situation to the processing of personal data concerning them, which is necessary for the fulfilment of a task in the public interest or which is carried out in the exercise of official authority (Article 21 GDPR: right of objection),
  • to lodge a complaint at any time with a supervisory authority, in particular in the Member State where you are staying, working or allegedly infringing, if you believe that the processing of personal data concerning you is contrary to applicable law (Article 77 GDPR in conjunction with § 19 BDSG: right to lodge a complaint with an controlling institution.)

If you have given us your consent, you finally have the right to revoke your consent at any time. All data processing that we have carried out up to your revocation remains legal in this case. To do so, simply click on the link contained in each email and unsubscribe from the email service or send a message to datenschutz [at] stimawell-ems.de (datenschutz[at]stimawell-ems[dot]de). If you tell us in this message that you do not want to receive future emails, we will not send any more messages to the email address you have provided. This does not affect emails that we send to you for the fulfilment of a possible contract concluded with you (for example, settlement offers requested by you).

7. Your obligation to provide personal data

You have no contractual or legal obligation to provide us with personal data. However, without the information you provide, we will not be able to conduct the sweepstake.

8. Security

We use technical and organizational security measures to ensure that your personal data is protected against loss, incorrect changes or unauthorized access by third parties. In any case, only authorized persons have access to your personal data from our side, and this only insofar as it is necessary within the scope of the above-mentioned purposes. The security measures are constantly adapted to the improved technical possibilities.

Of course you have the possibility to revoke your consent at any time. 9. Which internet specific data processing is required​

a) Cookies

We use so-called cookies on our Internet pages. These are small files that are stored on your hard disk and through which certain information flows to us. This information includes, in particular, the login (your visit), the date and time of your visit to us, the cookie number and the URL of the website from which you accessed our offer pages. The corresponding data is stored on servers of our service provider.

The use of cookies initially enables us to recognize you. Furthermore, cookies enable us to optimally adapt our offer to your individual needs. We also use cookies to record the statistical frequency of visits to the various pages of our website as well as general navigation.

However, if you wish to prevent the use of cookies, your browser can prevent the acceptance and storage of new cookies. You can also use our offer in this case, but the scope of services may be limited. b) Facebook Pixel

We use the Facebook pixel of Facebook Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland on our pages. This offers several functions, of which we use the Custom Audiences function. This allows you - if you have a Facebook account - to see our ads on Facebook. The Facebook Pixel establishes a direct connection between your page and the Facebook servers. Your usage data is transmitted to Facebook for analysis and marketing purposes. If you have a Facebook account, this data can be assigned to you. Tracking may allow Facebook to track your activities across multiple pages. We have no control over any processing of personal data, as this is the sole responsibility of Facebook. c) Facebook Social Plugins

This site uses social plugins ("plugins") of the social network facebook.com, which is operated by Facebook Inc, 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook"). The plugins can be recognized by one of the Facebook logos (white "f" on blue tile or a "thumbs up" sign) or are marked with the addition "Facebook Social Plugin". The list and appearance of Facebook Social Plugins can be viewed here: https://developers.facebook.com/docs/plugins/.

When a user visits a website on this site that contains such a plugin, his browser establishes a direct connection to Facebook's servers. The content of the plugin is transmitted directly from Facebook to your browser and integrated into the website. The provider therefore has no influence on the extent of the data that Facebook collects with the help of this plugin and therefore informs users according to their level of knowledge:

By integrating the plugins, Facebook receives information that a user has called up the corresponding page of the offer. If the user is logged in to Facebook, Facebook can assign the visit to his Facebook account. When users interact with the plugins, for example by pressing the Like button or making a comment, the corresponding information is transmitted directly from your browser to Facebook and stored there. If a user is not a member of Facebook, it is still possible for Facebook to obtain and store their IP address. According to Facebook, only an anonymized IP address is stored in Germany.

If a user is a Facebook member and does not want Facebook to use this offer to collect data about him or her and link it to his or her membership data stored on Facebook, he or she must log out of Facebook before visiting the website.

It is also possible to block Facebook social plugins with add-ons for your browser, for example with the "Facebook Blocker".

d) Google Analytics

This website uses the web analysis service Google Analytics and the service Google Remarketing, both offers of Google Inc. "("Google"). Through the Google Remarketing service, users who have already visited our Internet pages and online services and are interested in the offer are again addressed through targeted advertising on the pages of the Google Partner Network. The insertion of the advertisement takes place via the use of cookies. The text files can be used to analyse user behaviour when visiting the website and can then be used for targeted product recommendations and interest-based advertising. Google Analytics also uses cookies. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. However, we use Google Analytics with the function anonymousmizeIP, which makes the IP address absolutely anonymous by masking.

Google will use the information to evaluate your use of the website, to compile reports on the website activities for the website operators and to provide further services associated with the use of the website and the Internet. Google may also transfer this information to third parties if this is required by law or if third parties process this data on behalf of Google. Third-party providers, including Google, also use the information stored in the cookies as part of the Google Remarketing service to serve ads on other websites based on a user's previous visits to this website. Under no circumstances will Google associate your already masked IP address with other Google data.

You may refuse the use of cookies by selecting the appropriate settings on your browser software or by installing a browser add-on (available at: https://tools.google.com/dlpage/gaoptout?hl=en); however, please note that if you do this you may not be able to use the full functionality of this website. By using this website, you consent to the processing of data about you by Google in the manner and for the purposes set out above.

d) MyFonts Counter

Data is collected and stored on our site by MyFonts Counter, a web analysis service of the provider Monotype Imaging Holdings Inc, MyFonts Inc, 600 Unicorn Park Drive, Woburn, MA 01801, USA, from which user profiles are created using pseudonyms. These usage profiles serve the analysis of visitor behaviour and are evaluated for the improvement and demand-oriented design of our offer. Cookies may be used for this purpose. These are small text files that are stored locally on the visitor's computer and thus enable recognition when he or she visits our website again. The pseudonymised user profiles are not combined with personal data about the bearer of the pseudonym without the express consent of the data subject to be given separately. e) Trusted Shops

The Trusted Shops Trustbadge is included on this website to display our Trusted Shops seal of approval and any collected evaluations as well as to offer Trusted Shops products to buyers after an order. This serves the protection of our legitimate interests in an optimal marketing of our offer, which predominate in the context of a balancing of interests. The Trustbadge and the services advertised with it are an offer of Trusted Shops GmbH, Subbelrather Str. 15C, 50823 Cologne. When the trust badge is called up, the web server automatically saves a so-called server log file which, for example, contains your IP address, the date and time of the call, the amount of data transferred and the requesting provider (access data) and documents the call. This access data is not evaluated and is automatically overwritten at the latest seven days after the end of your page visit. Further personal data is only transferred to Trusted Shops if you decide to use Trusted Shops products after completing an order or have already registered for use. In this case the contractual agreement between you and Trusted Shops applies.
